§ 1 Parteien und Geltung

1. Diese Bedingungen gelten für den Kauf von Lizenzen für AudioBalance über audio-balance.com und für die Nutzung von AudioBalance mit einer solchen Lizenz.
2. Verkäufer, Lizenzgeber und dein Vertragspartner ist Jeremy Heindrichs, Einzelunternehmen (natürliche Person), Zur Hütte 36, 4750 Bütgenbach, Belgien, Unternehmensnummer (KBO/BCE) 1042.329.831, MwSt-Nr. BE1042.329.831, Telefon +32 492 92 76 99, E-Mail support@audio-balance.com („wir“).
3. Die Zahlung wickelt für uns Sold through Link, LLC („Link“) ab, ein Unternehmen der Stripe-Gruppe, erreichbar über die Hilfeseiten von Link (support.link.com). Link tritt dabei im eigenen Namen auf: Link nimmt den Preis entgegen, schickt dir den Beleg und führt die MwSt ab; für die MwSt gilt Link als Wiederverkäufer. Mit deiner Zahlung an Link hast du uns bezahlt. Für die Zahlung gelten zusätzlich die Käuferbedingungen von Link (link.com/terms).
4. Lädst du AudioBalance aus dem Microsoft Store, gelten für den Download die Bedingungen von Microsoft. Eine Lizenz kaufst du immer auf audio-balance.com.

§ 2 Vertragsschluss

1. Auf der Kaufseite wählst du die Variante (Normal oder Pro) und die Zahlweise (Einmalkauf oder Monatsabo) und klickst auf „Jetzt kaufen“. Damit hast du noch nichts bestellt; bestellt wird erst auf der Zahlungsseite.
2. Auf der Zahlungsseite von Link siehst du Produkt, Preis und deine Angaben. Du kannst Eingabefehler dort korrigieren oder abbrechen. Mit dem Klick auf die zahlungspflichtige Bestellschaltfläche bestellst du verbindlich. Der Vertrag mit uns kommt zustande, sobald Link die Zahlung bestätigt. Zugleich erhältst du von uns die Lizenz nach diesen Bedingungen.
3. Danach schicken wir dir per E-Mail die Bestellübersicht und deinen Aktivierungscode, dazu diese Bedingungen und die Widerrufsbelehrung als Anhang. Beleg und Rechnung schickt dir Link. Wir speichern den Vertragstext. Die jeweils aktuelle Fassung steht auf dieser Seite.
4. Vertragssprachen sind Deutsch und Englisch.
5. Aus einigen Ländern ist ein Kauf noch nicht möglich. Das zeigt dir die Kaufseite, bevor du bezahlst.

§ 3 Produkte und Preise

1. AudioBalance gibt es in zwei Varianten mit demselben Funktionsumfang. Sie unterscheiden sich nur darin, auf wie vielen Geräten AudioBalance gleichzeitig aktiviert sein darf. Jede Variante kannst du einmal kaufen oder monatlich bezahlen.

2. Alle Preise sind Endpreise in Euro inklusive MwSt. Ein Jahresabo gibt es nicht.
3. Zahlst du in einer anderen Währung, rechnet Link um. Es gilt der Betrag, den Link dir vor dem Bestellen anzeigt.
4. Ein Wechsel von Normal zu Pro ist ein neuer Kauf zum vollen Preis. Ein früherer Kauf wird nicht angerechnet.

§ 4 Testphase

1. Neue Nutzer können AudioBalance 7 Tage lang kostenlos mit allen Funktionen testen, ohne Zahlungsdaten anzugeben. Das gilt auch für Geräte, auf denen AudioBalance in der Beta lief.
2. Die Testphase endet von selbst und geht nicht in ein Abo über. Damit sie nicht missbraucht wird, gibt es sie einmal je Gerät und nur wenige Male je Netzwerk. Ein Gerät, das du von einer Lizenz entfernt hast, bekommt in den 90 Tagen danach keine Testphase (§ 8 Abs. 5). Bekommst du zu Unrecht keine, schreib an support@audio-balance.com; wir schalten dir eine frei.
3. Auch in der Testphase prüft AudioBalance online, mindestens alle 2 Tage (§ 8 Abs. 2).
4. Schließt du während der Testphase ein Abo ab, beginnt die Abrechnung sofort. Der Rest der Testphase verfällt.
5. Nach der Testphase kannst du AudioBalance nur mit einer Lizenz weiter nutzen.

§ 5 Einmalkauf und Hauptversion

1. Mit dem Einmalkauf nutzt du AudioBalance dauerhaft: die gekaufte Hauptversion mit allen kleinen Updates, ohne weitere Kosten. Dafür muss dein PC ab und zu kurz online sein (§ 8 Abs. 2). Kleine Updates und Sicherheitsupdates für die gekaufte Hauptversion gibt es mindestens 12 Monate ab Kaufdatum.
2. Kommt eine neue Hauptversion, kannst du für 4,99 € (Pro 6,99 €) upgraden, freiwillig und einmal je Hauptversion. Deine Lizenz gilt danach für die neue und alle älteren Hauptversionen; Aktivierungscode und Geräte bleiben gleich.
3. Deine gekaufte Version bleibt gültig. Eine neue Hauptversion macht sie nie ungültig, du kannst sie ohne Upgrade weiter nutzen.

§ 6 Monatsabo

1. Das Abo läuft unbefristet und wird monatlich im Voraus abgerechnet. Es umfasst jeweils die aktuelle Vollversion von AudioBalance, auch neue Hauptversionen, ohne Upgradegebühr.
2. Du kannst jederzeit zum Ende des bezahlten Monats kündigen, über „Verträge hier kündigen“ (audio-balance.com/kuendigen), unter Mein Konto oder bei Link auf link.com. Bis dahin kannst du AudioBalance weiter nutzen.
3. Nach dem Ende des Abos kannst du AudioBalance nicht mehr nutzen, außer du hast zusätzlich eine dauerhafte Lizenz aus einem Einmalkauf.
4. Den Abopreis ändern wir nur aus einem sachlichen Grund, etwa gestiegenen Kosten, und kündigen das mindestens 30 Tage vorher per E-Mail an. Bis dahin kannst du kostenlos kündigen. Der neue Preis gilt erst ab dem darauf folgenden Abrechnungsmonat.
5. Schlägt eine Zahlung fehl, kannst du AudioBalance bis zum Ende des bezahlten Zeitraums und 14 Tage darüber hinaus weiter nutzen. In dieser Zeit kann die Zahlung nachgeholt werden. Gelingt sie bis dahin nicht, endet das Abo.
6. Schließt du das Abo während deiner Testphase ab, beginnt die Abrechnung sofort. Der Rest der Testphase verfällt.
7. Wird eine Abo-Zahlung voll erstattet, etwa nach einem Widerruf, oder zurückgebucht, endet das Abo sofort, und es wird nichts mehr abgebucht. Eine Teilerstattung lässt das Abo weiterlaufen.

§ 7 Beta-Rabatt

1. Den Beta-Rabatt bekommst du, wenn sich dein Gerät vor dem Ende der Beta bei unserem Server gemeldet hat (AudioBalance tut das beim Start von selbst) oder wenn du vor dem Ende der Beta ein Konto bei AudioBalance angelegt und deine E-Mail-Adresse bestätigt hast. Den Rabatt über ein Konto gibt es einmal je E-Mail-Postfach; Adressen, die im selben Postfach ankommen (etwa mit „+“-Zusatz), zählen als eine. Die Beta endet um 23:59:59 Uhr belgischer Zeit an dem Tag, den wir auf audio-balance.com als letzten Beta-Tag bekanntgeben. Beenden wir sie erst später, gilt der spätere Tag.
2. Die Berechtigung erkennen wir automatisch, wenn du die Kaufseite aus AudioBalance heraus öffnest, auf der Kaufseite deinen Beta-Code eingibst oder dich mit einem Konto anmeldest, das mit deinem Beta-Gerät verbunden ist. Deinen Beta-Code zeigt dir AudioBalance im Menü unter „Lizenz & Geräte“. Dein Konto kannst du auch nach dem Ende der Beta mit deinem Beta-Gerät verbinden: Melde dich dafür in AudioBalance auf diesem Gerät an.
3. Erkennen wir dich nicht, schreib an support@audio-balance.com. Wir prüfen deine Angaben und schicken dir einen persönlichen Link mit dem Beta-Preis. Hast du als Beta-Nutzer schon zum vollen Preis gekauft und deinen Rabatt noch nicht genutzt, erstatten wir dir den Unterschied zum Beta-Preis, ohne Frist.
4. Der Rabatt beträgt 50 % auf deinen ersten Einmalkauf (Normal oder Pro). Der Beta-Preis ist die Hälfte des Listenpreises, abgerundet auf volle Cent. Maßgeblich sind die 50 %; bei den heutigen Listenpreisen sind das 7,49 € für Normal und 9,99 € für Pro, der Unterschied also 7,50 € bzw. 10,00 €.
5. Der Rabatt gilt einmal je Beta-Nutzer. Dein Gerät und ein Konto, das mit diesem Gerät verbunden ist, teilen sich diesen einen Rabatt. Wird der Kauf mit Beta-Preis widerrufen, voll erstattet oder zurückgebucht, kannst du den Rabatt erneut nutzen. Das geht höchstens zweimal.
6. Für das Monatsabo und für Upgrades auf eine neue Hauptversion gibt es keinen Beta-Rabatt.
7. Der Rabatt hat keine Einlösefrist.
8. Dein Beta-Code ist persönlich. Gibst du ihn weiter, kann ein anderer deinen Rabatt verbrauchen. Der Rabatt ist nicht übertragbar und nicht mit anderen Rabatten kombinierbar. Den Beta-Preis siehst du auf der Kaufseite, bevor du bezahlst.

§ 8 Aktivierung und technische Schutzmaßnahmen

1. AudioBalance wird online aktiviert. Dafür braucht dein PC einmal eine Internetverbindung. Danach läuft AudioBalance bei einem Einmalkauf bis zu 14 Tage offline, beim Abo bis zu 7 Tage (Abs. 2). Kaufst du aus einer aktuellen Version von AudioBalance heraus, schalten wir den PC, von dem aus du gekauft hast, nach der Zahlung in der Regel von selbst frei und nennen dir seinen Namen in der Kaufmail. Sonst und für weitere PCs aktivierst du AudioBalance mit E-Mail-Adresse und Aktivierungscode oder, wenn du in AudioBalance angemeldet bist, mit „Diesen PC hinzufügen“. Ein Monatsabo lässt sich nur in einer aktuellen Version von AudioBalance aktivieren.
2. AudioBalance prüft die Lizenz online beim Start und regelmäßig. Beim Einmalkauf muss dein PC mindestens alle 14 Tage kurz online sein, beim Abo alle 7 Tage, in der Testphase alle 2 Tage. Sonst pausiert die Regelung, dein Ton läuft weiter.
3. Jede Aktivierung ist an eine Gerätekennung gebunden, die AudioBalance aus Hardwaremerkmalen deines PCs berechnet (Prozessor, Datenträger, Netzwerkadapter). Zusätzlich legt AudioBalance auf deinem PC einen zufälligen Gerätenachweis an, an dem wir dieselbe Installation wiedererkennen.
4. Gleichzeitig aktiviert sein dürfen mit Normal 3 und mit Pro 5 Geräte. Jedes Gerät kannst du selbst entfernen, auch den PC, an dem du gerade sitzt: in AudioBalance unter „Lizenz & Geräte“ oder unter Mein Konto, das du mit der E-Mail-Adresse deines Kaufs anlegst. Ohne Konto gibst du ein Gerät auf der Seite „PC freigeben“ (audio-balance.com/konto-geraete) mit der E-Mail-Adresse deines Kaufs und deinem Aktivierungscode frei. Danach kannst du ein anderes Gerät aktivieren.
5. Ein entferntes Gerät ist gesperrt, bis du es wieder hinzufügst, und bekommt in den 90 Tagen nach dem Entfernen keine Testphase. Ist es gerade offline, merkt es das erst bei der nächsten Prüfung (Abs. 2). Damit Plätze nicht reihum geteilt werden, kannst du innerhalb von 30 Tagen höchstens doppelt so oft selbst Geräte entfernen, wie deine Lizenz Plätze hat (Normal 6, Pro 10). Brauchst du mehr, hilft dir der Support.
6. Ändert sich nur die Gerätekennung, etwa durch einen neuen Netzwerkadapter, erkennt AudioBalance deinen PC in der Regel am Gerätenachweis wieder, ohne einen weiteren Platz zu belegen. Nach einer Neuinstallation von Windows oder auf einem neuen PC zählt er als neues Gerät. Gib das alte Gerät dann frei.
7. Nach einer Erstattung, einer Rückbuchung, einem Widerruf oder dem Ende eines Abos wird die Lizenz gesperrt. AudioBalance merkt das bei der nächsten Prüfung. Entscheidet die Bank eine Rückbuchung zu unseren Gunsten, gilt die Lizenz wieder.

§ 9 Nutzungsrechte

1. Du erhältst ein einfaches, nicht übertragbares Recht, AudioBalance privat und beruflich auf deinen eigenen Geräten innerhalb der Gerätegrenze zu nutzen, beim Abo für seine Laufzeit.
2. Nicht erlaubt ist, die Lizenz oder den Aktivierungscode weiterzugeben oder zu verkaufen, die Schutzmaßnahmen aus § 8 zu umgehen und AudioBalance zu dekompilieren oder zu verändern, soweit das Gesetz dies nicht ausdrücklich erlaubt.
3. Alle anderen Rechte an AudioBalance bleiben bei uns.

§ 10 Systemvoraussetzungen und Kompatibilität

1. AudioBalance läuft unter Windows 10 und 11 mit 64 Bit (x64). Für die Installation brauchst du Administratorrechte, für Aktivierung und Lizenzprüfung ab und zu eine Internetverbindung (§ 8 Abs. 2).
2. Auf Windows mit ARM-Prozessor ist AudioBalance nicht getestet. Den Betrieb dort sichern wir nicht zu.
3. Für die automatische Regelung (Auto-Pegel) nutzt AudioBalance VB-CABLE von VB-Audio Software (Donationware, www.vb-cable.com). VB-CABLE ist ein eigenes Programm von VB-Audio und nicht Teil der Lizenz. Ohne VB-CABLE läuft AudioBalance im Kompatibilitätsmodus mit dem Begrenzer, aber ohne Auto-Pegel.
4. AudioBalance verzögert den Ton um etwa 100 ms, VB-CABLE um etwa 90 ms. Bluetooth-Kopfhörer und Bluetooth-Lautsprecher fügen ihre eigene Verzögerung hinzu.
5. Programme, die den exklusiven Audiomodus von Windows nutzen, laufen an AudioBalance vorbei.
6. Eine Lizenz gilt für die Version von der Website und für die Version aus dem Microsoft Store.

§ 11 Widerrufsrecht

Als Verbraucher kannst du einen Kauf innerhalb von 14 Tagen ab Vertragsschluss ohne Angabe von Gründen widerrufen. Die Widerrufsbelehrung, das Muster-Widerrufsformular und die Funktion „Vertrag widerrufen“ findest du unter audio-balance.com/widerruf. Richte den Widerruf an uns.

Nach einem Widerruf über das Formular bekommst du eine E-Mail mit einem Link. Ein Klick darauf startet die Rückzahlung sofort. Ohne Klick zahlen wir spätestens 14 Tage nach Eingang deines Widerrufs zurück. Das Geld geht über Link auf dein ursprüngliches Zahlungsmittel zurück, und wir sperren die Lizenz.

§ 12 Gewährleistung

1. Es gilt die gesetzliche Gewährleistung für digitale Inhalte (Art. 1701/1 ff. des alten belgischen Zivilgesetzbuchs).
2. Beim Einmalkauf haften wir für Vertragswidrigkeiten, die sich innerhalb von zwei Jahren nach der Bereitstellung zeigen, beim Abo während der ganzen Laufzeit.
3. Wir stellen dir die Updates bereit, die nötig sind, damit AudioBalance vertragsgemäß bleibt, auch Sicherheitsupdates, und informieren dich darüber.
4. Melde Mängel bitte an support@audio-balance.com.

§ 13 Haftung

1. Wir haften unbeschränkt bei Vorsatz, grober Fahrlässigkeit und Arglist, für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit und überall dort, wo zwingendes Recht eine Beschränkung nicht erlaubt.
2. Im Übrigen haften wir bei leichter Fahrlässigkeit nur für die Verletzung wesentlicher Vertragspflichten und nur für den bei Vertragsschluss vorhersehbaren, vertragstypischen Schaden.
3. Deine Rechte aus der gesetzlichen Gewährleistung bleiben unberührt.

§ 14 Änderungen

1. Wir entwickeln AudioBalance weiter. Bei einem laufenden Abo ändern wir die Software über das zur Vertragsmäßigkeit Nötige hinaus nur aus einem triftigen Grund, ohne zusätzliche Kosten für dich und mit einer klaren Ankündigung. Beeinträchtigt eine solche Änderung deine Nutzung mehr als nur geringfügig, kannst du das Abo innerhalb von 30 Tagen nach der Ankündigung oder der Änderung kostenlos beenden, je nachdem, was später ist.
2. Diese Bedingungen ändern wir für laufende Abos nur mit einer Ankündigung per E-Mail mindestens 30 Tage vorher. Bis dahin kannst du kündigen. Für einen Einmalkauf gilt die Fassung, die beim Kauf galt.

§ 15 Anwendbares Recht

Es gilt belgisches Recht. Als Verbraucher behältst du den Schutz der zwingenden Vorschriften deines Wohnsitzlandes. Einen Gerichtsstand vereinbaren wir nicht; es gelten die gesetzlichen Regeln.

§ 16 Beschwerden und Schlichtung

Beschwerden richte bitte zuerst an support@audio-balance.com. Finden wir keine Lösung, kannst du dich an den Ombudsdienst für Verbraucher wenden (Consumentenombudsdienst, Service de Médiation pour le Consommateur), Koning Albert II-laan 8 bus 1, 1000 Brüssel, Belgien, ombudsdienstverbraucher.be. Wir sind bereit, an einem Verfahren vor dem Ombudsdienst für Verbraucher teilzunehmen.

§ 17 Sprachen

Diese Bedingungen gibt es auf Deutsch und Englisch. Es gilt die Fassung in der Sprache, in der du den Vertrag geschlossen hast.

§ 1 Parties and scope

1. These terms apply to buying licenses for AudioBalance on audio-balance.com and to using AudioBalance with such a license.
2. The seller, licensor and your contract partner is Jeremy Heindrichs, sole proprietorship (natural person), Zur Hütte 36, 4750 Bütgenbach, Belgium, company number (KBO/BCE) 1042.329.831, VAT number BE1042.329.831, phone +32 492 92 76 99, email support@audio-balance.com (“we”).
3. Payment is handled for us by Sold through Link, LLC (“Link”), a Stripe company, reachable through Link’s help pages (support.link.com). Link acts in its own name: it collects the price, sends you the receipt and pays the VAT; for VAT purposes Link counts as reseller. Your payment to Link is your payment to us. Link’s buyer terms also apply to the payment (link.com/terms).
4. If you download AudioBalance from the Microsoft Store, Microsoft’s terms apply to the download. You always buy a license on audio-balance.com.

§ 2 Conclusion of the contract

1. On the pricing page you choose the variant (Normal or Pro) and how to pay (one-time purchase or monthly subscription) and click “Buy now”. This is not yet an order; you order only on the payment page.
2. On Link’s payment page you see the product, the price and your details. You can correct input errors there or cancel. By clicking the order button that obliges you to pay, you place a binding order. The contract with us is concluded as soon as Link confirms the payment. At the same time you receive the license from us under these terms.
3. We then email you the order summary and your activation code, with these terms and the withdrawal instructions attached. Link sends you the receipt and invoice. We store the contract text. The current version is always on this page.
4. The contract languages are German and English.
5. Purchases are not yet possible from some countries. The pricing page tells you before you pay.

§ 3 Products and prices

1. AudioBalance comes in two variants with the same features. They differ only in the number of devices on which AudioBalance may be activated at the same time. You can buy each variant once or pay monthly.

2. All prices are final prices in euro including VAT. There is no yearly subscription.
3. If you pay in another currency, Link converts the price. The amount Link shows you before you order applies.
4. Switching from Normal to Pro is a new purchase at the full price. An earlier purchase is not credited.

§ 4 Trial

1. New users can try AudioBalance free of charge for 7 days with every feature, without entering payment details. This also applies to devices on which AudioBalance ran during the beta.
2. The trial ends by itself and does not turn into a subscription. To prevent abuse it is available once per device and only a few times per network. A device you removed from a license gets no trial for 90 days afterwards (§ 8 (5)). If you wrongly get none, write to support@audio-balance.com and we unlock one for you.
3. During the trial, too, AudioBalance checks online at least every 2 days (§ 8 (2)).
4. If you take out a subscription during the trial, billing starts at once. The rest of the trial lapses.
5. After the trial you can only keep using AudioBalance with a license.

§ 5 One-time purchase and major version

1. With the one-time purchase you use AudioBalance permanently: the major version you bought with all minor updates, at no extra cost. For this your PC needs to be online briefly now and then (§ 8 (2)). Minor updates and security updates for the major version you bought are provided for at least 12 months from the purchase date.
2. When a new major version comes out, you can upgrade for €4.99 (Pro €6.99), optionally and once per major version. Your license then covers the new and all earlier major versions; activation code and devices stay the same.
3. The version you bought stays valid. A new major version never makes it invalid, and you can keep using it without an upgrade.

§ 6 Monthly subscription

1. The subscription runs for an indefinite period and is billed monthly in advance. It always covers the current full version of AudioBalance, including new major versions, without an upgrade fee.
2. You can cancel at any time with effect from the end of the paid month, via “Cancel contracts here” (audio-balance.com/kuendigen), under My account or with Link on link.com. Until then you can keep using AudioBalance.
3. After the subscription ends you can no longer use AudioBalance, unless you also hold a permanent license from a one-time purchase.
4. We change the subscription price only for an objective reason, such as higher costs, and announce it by email at least 30 days in advance. Until then you can cancel free of charge. The new price applies only from the following billing month.
5. If a payment fails, you can keep using AudioBalance until the end of the paid period and for 14 days beyond it. During that time the payment can be made up. If it does not succeed by then, the subscription ends.
6. If you take out the subscription during your trial, billing starts at once. The rest of the trial lapses.
7. If a subscription payment is refunded in full, for example after a withdrawal, or charged back, the subscription ends at once and nothing more is charged. A partial refund leaves the subscription running.

§ 7 Beta discount

1. You get the beta discount if your device reported to our server before the end of the beta (AudioBalance does this by itself at start) or if you created an AudioBalance account and confirmed your email address before the end of the beta. The discount through an account is available once per mailbox; addresses that arrive in the same mailbox (for example with a “+” suffix) count as one. The beta ends at 23:59:59 Belgian time on the day we announce on audio-balance.com as the last beta day. If we end it later, the later day applies.
2. We recognise eligibility automatically when you open the pricing page from within AudioBalance, enter your beta code on the pricing page or sign in with an account that is linked to your beta device. AudioBalance shows your beta code in the menu under “License & devices”. You can link your account to your beta device even after the end of the beta: sign in to AudioBalance on that device.
3. If we do not recognise you, write to support@audio-balance.com. We check your details and send you a personal link with the beta price. If you are a beta user, already bought at the full price and have not used your discount yet, we refund the difference to the beta price, without a deadline.
4. The discount is 50% on your first one-time purchase (Normal or Pro). The beta price is half the list price, rounded down to the full cent. The 50% is what counts; at today’s list prices this is €7.49 for Normal and €9.99 for Pro, so the difference is €7.50 or €10.00.
5. The discount applies once per beta user. Your device and an account linked to this device share this one discount. If the purchase at the beta price is withdrawn, refunded in full or charged back, you can use the discount again. This is possible at most twice.
6. There is no beta discount on the monthly subscription or on upgrades to a new major version.
7. The discount has no redemption deadline.
8. Your beta code is personal. If you pass it on, someone else can use up your discount. The discount is not transferable and cannot be combined with other discounts. You see the beta price on the pricing page before you pay.

§ 8 Activation and technical protection measures

1. AudioBalance is activated online. For this your PC needs an internet connection once. After that AudioBalance runs offline for up to 14 days with a one-time purchase and up to 7 days with a subscription (see (2)). If you buy from within a current version of AudioBalance, we usually unlock the PC you bought from by itself after the payment and tell you its name in the purchase email. Otherwise, and for further PCs, you activate AudioBalance with your email address and activation code or, if you are signed in to AudioBalance, with “Add this PC”. A monthly subscription can only be activated in a current version of AudioBalance.
2. AudioBalance checks the license online at start and regularly. With a one-time purchase your PC must be online briefly at least every 14 days, with a subscription every 7 days, during the trial every 2 days. Otherwise the regulation pauses and your sound keeps playing.
3. Each activation is bound to a device identifier that AudioBalance calculates from hardware features of your PC (processor, drive, network adapter). In addition AudioBalance creates a random device proof on your PC, by which we recognise the same installation.
4. Normal allows 3 and Pro 5 devices to be activated at the same time. You can remove any device yourself, including the PC you are sitting at: in AudioBalance under “License & devices” or under My account, which you create with the email address of your purchase. Without an account, you release a device on the page “Remove a PC” (audio-balance.com/konto-geraete) with the email address of your purchase and your activation code. Then you can activate another device.
5. A removed device is locked until you add it again, and gets no trial for 90 days after the removal. If it is offline at the time, it notices this at the next check (see (2)). So that seats are not passed around, you can remove devices yourself at most twice as often as your license has seats within 30 days (Normal 6, Pro 10). If you need more, support helps you.
6. If only the device identifier changes, for example through a new network adapter, AudioBalance usually recognises your PC by its device proof without taking another seat. After reinstalling Windows or on a new PC it counts as a new device. Release the old device in that case.
7. After a refund, a chargeback, a withdrawal or the end of a subscription the license is blocked. AudioBalance notices this at the next check. If the bank decides a chargeback in our favour, the license is valid again.

§ 9 Rights of use

1. You receive a simple, non-transferable right to use AudioBalance privately and professionally on your own devices within the device limit, for a subscription for its term.
2. You may not pass on or sell the license or the activation code, circumvent the protection measures of § 8, or decompile or modify AudioBalance, unless the law expressly allows it.
3. All other rights in AudioBalance remain with us.

§ 10 System requirements and compatibility

1. AudioBalance runs on 64-bit (x64) Windows 10 and 11. Installing it needs administrator rights; activation and the license check need an internet connection now and then (§ 8 (2)).
2. AudioBalance is not tested on Windows with an ARM processor. We do not promise that it works there.
3. For automatic regulation (auto level) AudioBalance uses VB-CABLE by VB-Audio Software (donationware, www.vb-cable.com). VB-CABLE is a separate program by VB-Audio and not part of the license. Without VB-CABLE, AudioBalance runs in compatibility mode with the limiter but without auto level.
4. AudioBalance delays the sound by about 100 ms, VB-CABLE by about 90 ms. Bluetooth headphones and speakers add their own delay.
5. Programs that use the exclusive audio mode of Windows bypass AudioBalance.
6. One license covers the version from the website and the version from the Microsoft Store.

§ 11 Right of withdrawal

As a consumer you can withdraw from a purchase within 14 days of the conclusion of the contract without giving any reason. The withdrawal instructions, the model withdrawal form and the function “Withdraw from contract here” are at audio-balance.com/widerruf. Send your withdrawal to us.

After a withdrawal through the form you get an email with a link. One click on it starts the refund at once. Without a click we refund you at the latest 14 days after your withdrawal reached us. The money goes back to your original payment method through Link, and we block the license.

§ 12 Legal guarantee

1. The statutory guarantee for digital content applies (Art. 1701/1 et seq. of the former Belgian Civil Code).
2. For a one-time purchase we are liable for lack of conformity that becomes apparent within two years of supply, for a subscription throughout its term.
3. We provide the updates needed to keep AudioBalance in conformity with the contract, including security updates, and inform you about them.
4. Please report defects to support@audio-balance.com.

§ 13 Liability

1. We are liable without limitation for intent, gross negligence and fraud, for damage from injury to life, body or health, and wherever mandatory law does not allow a limitation.
2. Otherwise, in the case of slight negligence we are liable only for breach of essential contractual obligations and only for the damage that was foreseeable and typical for the contract when it was concluded.
3. Your rights under the statutory guarantee remain unaffected.

§ 14 Changes

1. We keep developing AudioBalance. For a running subscription we change the software beyond what is needed to keep it in conformity only for a valid reason, at no extra cost to you and with clear notice. If such a change affects your use more than only slightly, you can end the subscription free of charge within 30 days of the notice or of the change, whichever is later.
2. We change these terms for running subscriptions only with notice by email at least 30 days in advance. Until then you can cancel. For a one-time purchase, the version in force at the time of purchase applies.

§ 15 Applicable law

Belgian law applies. As a consumer you keep the protection of the mandatory rules of the country where you live. We do not agree on a place of jurisdiction; the statutory rules apply.

§ 16 Complaints and dispute resolution

Please send complaints to support@audio-balance.com first. If we cannot find a solution, you can turn to the Belgian Consumer Ombudsman Service (Consumentenombudsdienst, Service de Médiation pour le Consommateur), Koning Albert II-laan 8 box 1, 1000 Brussels, Belgium, consumerombudsman.be. We are willing to take part in proceedings before the Consumer Ombudsman Service.

§ 17 Languages

These terms exist in German and English. The version in the language in which you concluded the contract applies.
